I. Approval
A bank letter, or $5,000 credit card deposit is required for approval. The bank letter template can be downloaded from any listing located below the photos. A completed bank letter can either be faxed to 515-473-6485 or emailed to bid@housby.com. If you are unable to obtain a bank letter, Credit Card deposits are also accepted, and you will be directed to submitting a credit card deposit after accepting the terms and conditions. II. Fees
There will be a 12% transaction fee for all lots purchased above $5,000, with a $750 minimum, transaction fee is capped at $15,000. The transaction fee will be 15% for all lots purchased for $5,000 and under, with a $75 minimum.
III. Payments
Complete payment is due within 24 hours following the close of the sale. Invoices will be sent via email to the email address supplied on your account. Payments can be made by wire transfer, overnight certified/cashier’s check (business/personal checks may delay release until funds have cleared), or cash payments in person at our corporate office. To the extent full payment is not made within 24 hours of the sale ending time, interest will accrue at a rate of two percent (2%) per month of the successful bid amount. In accepting these terms, the successful Bidder authorizes Housby to charge against such Bidders payment method provided for participation in the sale any fees incurred. IV. Sold “As Is/Where Is”
All items are sold "As Is" / "Where Is" with no warranties either expressed or implied. Notes for guidance only, all sales are final after purchase. Bidders are encouraged to, and acknowledge they can, inspect the Equipment and are not relying upon any photos, videos, representation, statement or other assertions made with respect to the Equipment's condition. Bidders are relying upon its own knowledge regarding the Equipment and/or its own examination of the Equipment. Bidders take the Equipment knowing there are no express or implied warranties given on the Equipment.
V. Pickup Deadline & Possession
When Housby provides that any specific lot is "SOLD", the title for that property shall pass to the successful Bidder, who then and there assumes the full risk and responsibility for the property.
All property shall be removed from the sale premises by the successful Bidder and/or such Bidder's representative at his/her/its own risk and expense, within 10 business days. 24 hour notice to schedule pickup with yard is required. Failure to remove the property timely will result in storage costs and/or relocation fees assessed to the successful bidder. These announced and/or posted fees are to be collected prior to the equipment's release by each participating holding facility. In accepting these terms, the successful bidder acknowledges and agrees to the assessment of these storage costs and fees. Any damage caused by the removal of any property by any Bidder will result in assessment against the payment method provided by Bidder, the cost of replacement or repair. All Bidders, by acceptance of these terms, agree to and permit Housby to charge against the payment method provided on account of any damage caused by such Bidder. The resale of items from present location is not permitted. Violators are subject to additional fees, item relocation at owner's expense, and Housby reserves the right to suspend bidding privileges.
VI. Titles
Titles will be mailed 10 banking days after proper settlement via USPS Certified Mail. Expedited shipping methods are available upon request for an additional fee. Possession and responsibility for all titles mailed by Housby will shift to the buyer upon the generation of a valid tracking number. A $50 fee will apply to all title mailings returned due to an "Unclaimed" status, or an improper address.
VII. Taxes
Sales Tax may be charged to your purchases unless you provide us with a Tax Exempt form, Dealers license, or Resale certificate. These forms can be faxed to 515-473-6485 or emailed to bid@housby.com. Click here to download an Iowa Sales Tax Exempt certificate. Certain equipment consigned to this sale may be sold as part of an equipment exchange, pursuant to Section 1031 of the Internal Revenue Code, and the rights of the consignor under the Contract to Sell may be assigned to a third party Qualified Intermediary. This notice appears as a matter of record only.
VIII. Breach
Failure to follow or adhere to any of these terms is a breach of the terms of sale, and will result in account suspension from any future purchases with Housby, or any of its affiliates. Exceptions will not be made. Any fees due will be assessed against the payment method provided for credit verification and approval to bid. Any disagreement surrounding these terms and conditions shall be governed by Iowa law.
